By accessing or using our website, AI receptionist services, automated communication systems, or any related products or services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms and any additional policies referenced herein. If you do not agree to these Terms, you must not access or use our Services.

If you are using the Services on behalf of a business or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In that case, "you" and "your" will refer to that entity.

2. Services Provided

KJ Brands LLC provides AI receptionist setup and management services, as well as automated communication systems designed to support business operations, customer engagement, and related workflows. These Services may include, but are not limited to, AI-powered call handling, messaging workflows, scheduling assistance, and other automated or semi-automated customer communication tools.

We may add, modify, or discontinue features or functionalities of the Services at any time. We will make commercially reasonable efforts to notify you of any material changes that may impact your use of the Services. Your continued use of the Services following any such changes constitutes your acceptance of the modified Services.

3. User Responsibilities

When using our Services, you agree to the following responsibilities:

Provide accurate, current, and complete information when requested, including during onboarding, configuration, and billing.
Use the Services only for lawful purposes and in compliance with all applicable local, state, federal, and international laws and regulations.
Not misuse, abuse, or exploit the Services, including by attempting to reverse engineer, circumvent security measures, overload systems, or use the Services in a manner that could damage, disable, or impair our infrastructure or third-party providers.
Not interfere with or disrupt the integrity or performance of the Services, our website, or any systems, networks, or third-party services connected to the Services.
Ensure that any content, contact lists, or information you provide for use with the Services (including SMS or phone numbers) has been collected and is used in compliance with applicable laws, including consent and opt-in requirements.

You are solely responsible for the activities that occur under your accounts and for maintaining the confidentiality and security of any access credentials associated with the Services.

4. Payment Terms

We may offer a 14-day free trial period for certain Services. During the trial period, you may use the Services without being charged the subscription fee, subject to any limitations communicated at the time of signup.

Unless otherwise stated in a separate written agreement, after the 14-day free trial expires, the applicable subscription fee is $500 per month (or such other amount as may be clearly communicated to you at the time of purchase or renewal). By providing a payment method and continuing to use the Services after the trial, you authorize us (or our payment processor) to charge your payment method for the subscription amount and any applicable taxes on a recurring basis, in accordance with the billing cycle disclosed to you.

You are responsible for ensuring that your payment information is accurate and up to date and for all ongoing subscription payments after the trial period. If a payment is not successfully processed due to expiration, insufficient funds, or otherwise, we may suspend or terminate your access to the Services until all outstanding amounts are paid in full.

5. Cancellation

You may cancel your subscription at any time. If you cancel during the 14-day free trial period, you will not be charged any subscription fees, and your access to the Services may be terminated at the end of the trial.

If you cancel after the subscription period has begun, cancellation will take effect at the end of your current billing cycle, unless otherwise specified in a separate written agreement. You will remain responsible for all charges incurred through the end of the then-current billing period, and, except where required by law, subscription fees paid are non-refundable.

6. Limitation of Liability

To the maximum extent permitted by law, KJ Brands LLC and its officers, directors, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation any loss of profits, revenue, data, business opportunities, or goodwill arising out of or in connection with your use of, or inability to use, the Services.

Without limiting the foregoing, KJ Brands LLC is not liable for any business losses, missed opportunities, or lost revenue arising from AI receptionist behavior, automated communication workflows, missed messages, or misrouted communications, nor for any technical interruptions, delays, errors, or failures in the Services or in third-party networks or platforms used in connection with the Services.

In no event shall our total aggregate liability arising out of or related to these Terms or the use of the Services exceed the amount you have paid to us for the Services during the three (3) months immediately preceding the event giving rise to the claim. Some jurisdictions do not allow limitations on certain damages, so some of the above limitations may not apply to you.

7. Service Availability

The Services are provided on an "as is" and "as available" basis. While we use commercially reasonable efforts to maintain reliable and accessible Services, we do not warrant that the Services will be uninterrupted, timely, secure, error-free, or free from defects or vulnerabilities.

Service availability may be affected by factors beyond our control, including but not limited to internet or network outages, third-party platform failures, carrier issues, or force majeure events. We may from time to time perform scheduled maintenance, updates, or improvements that may temporarily affect access to the Services. We will use reasonable efforts to minimize disruptions where practicable.

8. SMS Messaging Terms

We may use SMS and other messaging channels as part of our Services to communicate with you and, where authorized by you, with your end customers. By providing a mobile phone number and opting in to receive SMS messages, you consent to receive text messages related to your use of the Services, including notifications, reminders, updates, and other service-related communications.

You can cancel the SMS service at any time. Just text "STOP" to +1 954-280-7643. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply. You will receive messages up to a few times per week based on your interaction with our services.

You represent and warrant that any phone numbers you provide to us for messaging are owned or controlled by you or that you have obtained all necessary permissions and consents required by law to enable us to send messages to such numbers on your behalf. You are responsible for complying with all applicable laws, regulations, and industry guidelines regarding SMS, including but not limited to opt-in, opt-out, and disclosure requirements for any campaigns you run using our Services.
